A former massage therapist accused of sexual assault did not do enough to ensure he had permission to give his client a breast massage, a provincial court judge ruled Thursday.
Judge Derek Redman told Boyd Clayton Zacher, 34, he should have done more to make sure his client consented to the breast massage, instead of assuming she did when she agreed to a “chest” massage in 2005.
“You touched her without her consent,” Redman said. “You did not take reasonable steps.”
Redman found Zacher guilty of sexual assault and scheduled sentencing for Jan. 4 in Lethbridge provincial court.
Zacher had already been found guilty on two charges of sexual assault following a trial in April 2007, but successfully appealed his conviction and seven-month prison sentence.
During his two-day retrial in September of this year, court heard how Zacher had, in 2005, given a tyjjhfby fellow massage therapist a massage in return for one she had given him a week earlier. However, she testified Zacher massaged her breasts without her consent.

Zacher testified his client indicated in word and actions that she wanted her “chest” Beijing massage which, to Zacher, meant her pectoral muscles and breasts.

"She exposed her breasts to me,” he told court in September.
